COUNTY COURT: Area man released on time served

RELEASED: Domestic dispute led to weapon charge for Albion resident.

A domestic dispute landed 30-year-old Joseph D. Sanderson, a convicted felon, in jail last October after Orleans County sheriff’s deputies said they discovered a shotgun in his vehicle.

Sanderson was released from custody Tuesday when Orleans County Court Judge James Punch granted him time served.

“He has essentially served the maximum sentence,” Punch said.

Sanderson chose to plead guilty to the second charge of the indictment, misdemeanor fourth-degree criminal possession of a weapon, on a plea bargain with the district attorney’s office before sentencing took place. Restitution was not requested, and there were no sentencing promises, said District Attorney Joseph Cardone.

Formerly of Crimson Heights, Albion, Sanderson was reportedly involved in a domestic incident in his driveway Sept. 18 when the Orleans County Sheriff’s Department responded to a complaint. They said they discovered a 12-gauge shotgun in open view on the back seat of his vehicle and pressed charges. Sanderson has been held in the Orleans County Jail on $10,000 bail ever since.

Convicted of felony fifth-degree criminal possession of a controlled substance in January 2004, Sanderson possessed the gun illegally, Punch said. He sentenced him to time already served in jail and a $160 surcharge, to be paid within 60 days. Sanderson and his attorney waived the pre-sentencing report.

Sanderson was originally arraigned in county court on the charges of felony third-degree criminal possession and misdemeanor fourth-degree criminal possession of a weapon.

In other county court news:

• Timothy E. Moyer, 39, Kent Road, Kent, was arraigned on two counts of felony driving while intoxicated and aggravated unlicensed operation. He posted $2,500 bail at Medina Village Court.

• Joshua B. Savage, 16, South Main Street, Holley, was arraigned on the charges of third-degree criminal possession of a weapon, fourth-degree grand larceny and two counts of fourth-degree criminal possession of a weapon. He posted $10,000 bond bail at Gaines Town Court.

• Donald J. Moyer, 20, Ridge Road, Holley, was arraigned on the charges of second-degree burglary, petit larceny and fourth-degree criminal mischief. He posted $2,500 bail through Carlton Town Court.

• Steven A. Meyer, 34, Clarendon Street, Albion, was arraigned on the charges of third-degree criminal sale of marijuana, two counts of fourth-degree criminal sale of marijuana, two counts of unlawfully dealing with a child, second-degree criminal nuisance and unlawful possession of marijuana. Punch set bail in the amount of $2,000.

• Matthew Stamp, 21, South Academy Street, Medina, was arraigned on a charge of fifth-degree criminal possession of a controlled substance. He is one of 10 defendants stemming from a countywide March drug bust. He posted $2,500 bail through Medina Village Court.

• Keith M. Lewandowski, North Avenue, Medina, was arraigned on the charge of violating probation. He pleaded guilty to fourth-degree criminal possession of stolen property last year.

• Amanda C. Hartman failed to appear in court as scheduled. A warrant was authorized for her arrest.
